HIPAA Doesn’t Begin to Cover It

HIPAA Doesn’t Begin to Cover It

You thought you were doing a good thing. Handing out subsidized fitness trackers, offering a mental health app, setting up digital biometric screenings—it all looks great on a recruiting brochure or an onboarding platform. You assume that because it’s "health data," HIPAA has it locked down and your hands are clean.

I hate to be the bearer of bad news, but that assumption is putting your business in serious jeopardy.

The HIPAA Illusion

Most employers think employee medical privacy starts and stops with HIPAA compliance. Here’s the reality: modern corporate wellness perks routinely bypass federal healthcare privacy protections entirely. Many of these third-party wellness vendors operate completely outside covered-entity regulations.

You have to understand how that puts you at risk.

This means the telemetry those devices gather—sleep cycles, geolocation, stress levels, and cycle tracking—isn't secured the way you think it is. Far too often, that unstructured data flows right back into your enterprise systems in semi-aggregated forms.

The HR Nightmare You Didn't See Coming

This is a completely hidden legal dilemma under the Americans with Disabilities Act (ADA), the Genetic Information Nondiscrimination Act (GINA), and a whole mess of new state-level health data laws.

If your enterprise systems ingest health telemetry that inadvertently reveals an employee is dealing with a chronic illness, a mental health crisis, or a pregnancy, you suddenly have a massive problem on your hands. If that employee is later disciplined, passed over for a promotion, or let go, you face acute liability in workplace discrimination disputes.

Even if your management team didn't intentionally look at the data, the fact that your systems integrated it and made it accessible is enough to trigger a devastating lawsuit.

Building the Firewall

The IT challenge here moves way beyond simple password protection or basic access control. It’s an architectural problem. Your IT team must engineer strict, undeniable data firewalls.

You need to ensure that your HR information systems and executive dashboards remain forensically blind to employee wellness data. If the data touches your network, it needs to be cordoned off so thoroughly that nobody making personnel decisions could possibly see it, even by accident.

Your first step should always be assessing what is actually coming into your environment:

  1. Audit your vendors - Review the contracts for every wellness app or device you subsidize. Find out exactly where that data is stored and who has access to it.
  2. Map the data flow - Determine if any of that telemetry is integrating with your internal dashboards, HR software, or email systems.
  3. Establish blind spots - Work with your IT provider to segment your network. HR should never have accidental access to aggregated health metrics.

The process of isolating this data is actually pretty simple if you architect your network correctly from the start. If you’ve already rolled out these perks without a plan, however, you need to audit where that data is going immediately. We can help you map your data flows and build the necessary firewalls to keep your company safe. To get help with your network, give us a call at (774) 213-9701.
